Am I exempt or non-exempt?
Exempt employees are paid salary AND meet specific duties tests (executive, administrative, professional, computer pro, outside sales). Job title doesn't determine it; actual duties do. Many salaried employees are misclassified.
What states have daily OT?
California (over 8 hrs/day and 12 hrs/day for double-time, plus 7th consecutive workday rules), Alaska (over 8 hrs/day), Nevada (over 8 hrs/day for lower-wage workers), and Colorado (over 12 hrs/day).
If my employer doesn't pay OT I'm owed, what do I do?
Document hours worked, communicate with your employer in writing, and if unresolved, file a complaint with your state Department of Labor or US DOL Wage and Hour Division. Many cases recover back wages plus penalties.
Does this include overtime for holidays?
Federal law doesn't require holiday premium pay — that's only required if it pushes you over the weekly threshold or your contract/CBA specifies.
